Welcome to Petsmate! These Terms and Conditions (“Terms”) govern your access to and use of the Petsmate website, mobile applications (iOS and Android), and all related services (collectively, the “Platform”). By creating an account or using our Platform, you agree to comply with and be bound by these Terms. If you do not agree, please do not use Petsmate.

1. Account Registration and Eligibility

Age Requirement: You must be at least 18 years old to create an account. If you are between 13 and 18, you may use the Platform only with the involvement and consent of a parent or guardian.

Account Accuracy: You agree to provide accurate, current, and complete information during registration and keep your profile updated.

Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately of any unauthorized use.

2. Animal Welfare and Community Guidelines

Petsmate is built on love and respect for animals. As a pet-focused social network, we have a Zero-Tolerance Policy for the following:

Animal Cruelty: Posting content that depicts, promotes, or encourages the abuse, neglect, or harm of any animal.

Illegal Breeding and Trading: Promoting puppy mills, unauthorized backyard breeding, or the sale of endangered, illegal, or exotic wildlife.

Animal Fighting: Any content related to dog fighting, cockfighting, or similar illegal activities.

Inappropriate Content: Hate speech, harassment, spam, or sexually explicit material. Violation of these guidelines will result in immediate account termination and, if applicable, reporting to local animal welfare authorities or law enforcement.

3. User-Generated Content (UGC)

Ownership: You retain ownership of the photos, videos, stories, and comments (“Content”) you post on Petsmate.

License to Petsmate: By posting Content, you grant Petsmate a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, and display that Content in connection with the Platform and Petsmate’s business operations (e.g., promoting the app).

Responsibility: You are solely responsible for the Content you post. Do not post copyrighted material without permission.

4. Pet Playdates and In-Person Meetups

Our “Find Playmates” and “Local Events” features allow users to connect in the real world.

Assumption of Risk: You acknowledge that bringing animals together carries inherent risks. Petsmate does not background-check users or evaluate the temperament, health, or vaccination status of pets on the Platform.

No Liability: Petsmate is not responsible for any injury, property damage, illness (e.g., transmission of kennel cough), or disputes that occur during in-person meetups, playdates, or events organized through our Platform. You arrange and attend these meetings entirely at your own risk.

5. Pet Marketplace and Adoption Support

Peer-to-Peer Platform: The Petsmate Marketplace and Adoption Support network act as a venue to connect buyers, sellers, adopters, and shelters. Petsmate is not a party to any transaction.

No Endorsement or Guarantee: We do not manufacture, store, or inspect any of the items sold through the Marketplace, nor do we guarantee the health, pedigree, or temperament of any pet listed for adoption.

Prohibited Items: You may not sell live animals in violation of local laws, prescription veterinary medicines, or hazardous pet products.

6. Expert Advice and Veterinary Disclaimer

General Information Only: The “Expert Advice” section, community forums, and tips provided by users or marked “professionals” on Petsmate are for informational and educational purposes only.

Not Medical Advice: Content on Petsmate is never a substitute for professional veterinary advice, diagnosis, or treatment. Always seek the advice of your veterinarian with any questions regarding your pet’s medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on Petsmate.

7. Intellectual Property

All original content, features, and functionality of the Platform (excluding User-Generated Content), including but not limited to the Petsmate logo, design, text, graphics, and software, are the exclusive property of Petsmate and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Petsmate (and its founders, employees, and affiliates) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from:

Your use or inability to use the Platform.

Any conduct or content of any third party on the Platform.

Any transactions or meetups facilitated through the Platform.

9. Modifications to the Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through an in-app alert. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Dehradun, Uttarakhand, India.
